These terms and conditions (“Agreement”) govern the use of the Lensgraphy website, social media, and the services provided by Lensgraphy, referred to as “the Company.” By accessing the website or using the services, you (“the Client” or “the User”) agree to be bound by these terms and conditions.

2. Scope of Services:

Events: Coverage of events as specified by the Client, including but not limited to corporate events, conferences, parties, and special occasions.

Weddings: Comprehensive coverage of wedding ceremonies and receptions, capturing candid moments, portraits, and highlights of the special day.

Portraits: Professional portrait photography sessions for individuals, couples, families, and groups, conducted at agreed-upon locations or in-studio

Headshots: High-quality headshot photography sessions for professionals, actors, models, and corporate teams, tailored to the Client’s specifications.

Properties: Photography and videography services for real estate properties, including interior and exterior shots, virtual tours, and drone footage, as requested by the Client.

The duration of our services will depend on the specific shoot and package chosen by the Client.

Our photography services may include capturing candid moments, portraits, group photos, and details of the events and weddings. The number of photos provided may vary depending on the event and package selected. Please note that while we strive to capture all key moments and aspects of the event, certain limitations or exclusions may apply based on factors such as venue restrictions, lighting conditions, and the event’s nature.

Additional features or options, such as photo retouching or post-processing services, may be available as add-ons.

3. Booking and Payment:

To book our photography services, the Client must submit a request through our website or contact our team directly. The availability of our services will be confirmed upon review and agreement between the Client and the Company.

Payment details, including the amount and accepted payment methods, will be provided during the booking process. A deposit or full payment may be required to secure the booking, and the remaining balance is typically due before or on the day of the event.

Cancellation or rescheduling of the photography services should be communicated to the Company as soon as possible. Depending on the notice provided and the circumstances, cancellation or rescheduling fees may apply. Refunds, if applicable, will be subject to the cancellation policy outlined in the agreement between the Client and the Company.

4. Intellectual Property Rights:

Raw photos will not be provided to the client.
The ownership and copyright of all photographs & video taken by Lensgraphy during the shoot remain with the Company. The Client does not acquire any ownership rights or copyright in the photographs.
Lensgraphy grants the Client a non-exclusive, non-transferable license to reproduce and use the photographs for personal or non-commercial purposes. However, the photographs may not be sold, distributed, or used for commercial purposes without the prior written consent of the Company.
By engaging our services, the Client grants Lensgraphy the right to use the captured photos and videos for promotional purposes. This includes, but is not limited to, displaying the photos and videos on our website, social media platforms, marketing materials, and portfolio. Lensgraphy may also sublicense these rights to third-party partners for promotional purposes. However, Lensgraphy will not sell the photos or videos to third parties for direct commercial use.

5. Privacy and Data Protection:

Lensgraphy is committed to protecting the privacy of its clients and users. The collection, use, storage, and protection of personal information provided by the Client or User is governed by our Privacy Policy. By using our services or accessing our website, you consent to the collection and use of personal information as described in the Privacy Policy.

Any personal data collected will be used for the purposes of providing photography services and fulfilling contractual obligations. Lensgraphy will not share personal information with third parties without the Client’s explicit consent, unless required by law or as necessary for the provision of services.

6. Liability and Indemnification:

Lensgraphy endeavors to provide professional and high-quality photography services. However, the Company shall not be liable for any damages, losses, or injuries incurred during the shoot, including but not limited to accidents, equipment failures, or acts of nature.

The Client assumes full responsibility for ensuring the safety and well-being of individuals and property during the event. The Client agrees to indemnify and hold Lensgraphy harmless from any claims, liabilities, or damages arising from the event or the Client’s actions or negligence.

7. Dispute Resolution and Governing Law:

In the event of any disputes or disagreements arising from this Agreement, the parties agree to first attempt to resolve the matter through good-faith negotiation.

If the dispute cannot be resolved through negotiation, the parties agree to pursue alternative dispute resolution methods, such as mediation or arbitration, as a means of resolving the dispute amicably and cost-effectively.

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where Lensgraphy operates, without regard to its conflict of law provisions.

8. Amendments and Termination:

Lensgraphy reserves the right to modify these terms and conditions at any time. The updated terms will be communicated to Clients or Users through the website or via email. Continued use of the services after the modifications constitutes acceptance of the revised terms and conditions.

Either party may terminate the agreement or the services by providing written notice to the other party. Termination of services may be subject to certain conditions or fees, as outlined in the specific agreement between the Client and the Company.

9. Miscellaneous:

Force Majeure: Lensgraphy shall not be liable for any delay or failure to perform its obligations under this Agreement due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, or government restrictions.
Non-Assignment: The Client may not assign or transfer any rights or obligations under this Agreement without the prior written consent of Lensgraphy.
Entire Agreement: This Agreement constitutes the entire understanding between the parties regarding the subject matter herein and supersedes all prior agreements, whether written or verbal.
Severability: If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
